PVH Corp., et al., ("Action"). The Action was filed against PVH Corp. and PVH Retail Stores LLC ("PVH" or "Defendants") by plaintiff Cally Fallenstein alleging PVH engaged in deceptive advertising by advertising purportedly improper discounts on merchandise at Calvin Klein Outlet Stores located in California. PVH denies wrongdoing and liability and both sides disagree on how much, if anything, the Class could have recovered after trial. No court has decided which side is right. But both sides agreed to provide benefits to Class Members and resolve the case. Am I a Class Member? You are a "Class Member" if between September 28, 2017 and October 19, 2023 (the "Class Period"), you purchased one or more items at any Calvin Klein Outlet Store located in the State of California, which item(s) was not returned by, or on behalf of, you, or otherwise (a "Qualifying Purchase") and you are not PVH's Counsel, a PVH officer or director, or the judge presiding over the Action. What relief does the Settlement provide? If you are a Class Member, you are eligible to receive one (1) Merchandise Certificate good for a maximum value of $10 off a single item (no minimum purchase) at a Calvin Klein Outlet Store located in the State of California (and at no other store, online site, or any location anywhere). You will have the ability to claim one (1) additional Merchandise Certificate by timely submitting a Claim Form together with proof that you made one or more Qualifying Purchases of at least $150.01 pre-tax in a single transaction during the Class Period. How do I receive a Merchandise Certificate(s)? If you received direct notice of the Settlement by email notice, you need not do anything to receive one (1) Merchandise Certificate(s). To qualify for one (1) Merchandise Certificate if you did not receive direct notice by email, you must send in a Claim Form and proof of Qualifying Purchase during the Class Period. If you made one or more Qualifying Purchases during the Class Period totaling at least $150.01 pre-tax in a single transaction, you must submit a Claim Form and proof of Qualifying Purchase to receive one (1) additional Merchandise Certificate by February 1, 2024.
